Terms of Service

Selfiestreet is a platform that allows the user to upload, schedule, share and broadcast, upon electronic payment, images, videos and multimedia files on billboards installed in places open to the public.

The platform may be used to: create and share content; interact with other users through messaging; view the content created by other users; create communities of users and use the other features that will be made available from time to time.

The user retains full control over the content uploaded and over the choices relating to its broadcasting, including the place, date and time of projection.

Selfiestreet does not perform an editorial role over users' content, nor does it exercise systematic prior control over it, without prejudice to the right to intervene subsequently for moderation, removal or blocking activities in accordance with these Terms and Conditions and the applicable legislation.

The broadcasting of content takes place on the initiative and under the responsibility of the user, who determines its modalities through the features made available by the platform.

Content broadcast via billboard

As provided in the content upload process, each user will be able to preview their own content in the Selfiestreet App prior to broadcasting. The audio track of each video upload will be automatically disabled.

Through the features of the Services, the user will be able to choose the day and time on which their content will be broadcast on the chosen billboard.

By choosing the place, date and time of broadcasting, the user will be able to decide whether to be physically present at the location where the Selfiestreet billboard is installed and to take part in its broadcasting remotely, by accessing the Selfiestreet App a few minutes before the broadcasting time for remote viewing, or by accessing the “recordings” menu to access content on deferred viewing, provided that less than 24 hours have elapsed since the broadcasting.

The choice of date and time of broadcasting of the content entails authorisation to send notifications to alert the user of the broadcasting itself.

We strive to provide the best possible service. However, we cannot guarantee minimum levels of service quality and we do not guarantee that our services will always operate without interruptions, delays or errors. Various factors beyond our control could also affect the user's experience and cause possible disruptions.

Points system and gamification

Description of the Service. The platform includes a gamification system that allows users to accumulate “Selfie Points” through interactions such as daily login, publication of posts, comments, “likes” and creation of communities.

Nature of the Points. Selfie Points and progression levels have no monetary value, are not convertible into legal tender, are not transferable to third parties and do not constitute a form of investment or savings.

Accumulation Limits. In order to ensure the quality of interactions and prevent abuse, daily limits on the accumulation of points are provided (e.g. a maximum of 50 likes and 25 comments per day that generate a score). Such limits may be modified by the Controller without notice.

Projection Vouchers. Upon reaching certain milestones (e.g. every 1,000 points/level), the user receives a projection voucher that allows them to schedule content on the physical billboards. The use of the voucher remains subject to all the moderation rules and technical requirements provided in these Terms.

Abuse and Penalties. Should Selfiestreet detect activities aimed at manipulating the scoring system (e.g. use of bots, duplicate accounts or spam), it reserves the right to reset the accumulated points, revoke the vouchers obtained or suspend the user's account.

To create a Selfiestreet account, the user must provide, at their choice, either their e-mail address or their mobile phone number. In addition, they must indicate a password of at least eight alphanumeric characters, taking care that it is not easily traceable to the user. It is important that the user takes appropriate measures to keep the password of their account secure and does not communicate it to third parties. If the user suspects that third parties are aware of their password or have gained access to their account, they must send an e-mail to info@selfiestreet.it.

The creation of a Selfiestreet account by persons who have not reached 16 years of age is not permitted.

Upon creation of the account, the user will be asked to indicate their date of birth. The user declares, under their own responsibility, that the information provided at registration is truthful.

The user is not required to reveal their identity on Selfiestreet, but must provide accurate and up-to-date information. If the user selects for their account a username or identifier similar to an already existing profile, Selfiestreet reserves the right to modify it, where deemed appropriate or necessary (for example, in the event of infringement of the intellectual property rights of others or the use of an identity not corresponding to their own).

Upon the successful completion of the registration process, the system will generate and assign an identification code (QR Code) for each user. By default, the Selfiestreet account of persons over 18 years of age is public, but the user will be able to choose to make it private at any time.

We want our Services to be as open and inclusive as possible, but also safe, secure and compliant with the applicable regulations. Therefore, in order to be part of the Selfiestreet community, the user is required to comply with the Terms and Conditions set out below. In this regard, we use a system that combines technology (including through automated means), human intervention and reports from users to identify any breaches and to enforce these Terms and Conditions. The authorisation granted to the user is limited to the actions permitted by these Terms and Conditions; it is exclusive to the user; it cannot be assigned by the user to third parties and may be revoked for the reasons set out in these Terms and Conditions. The following Terms and Conditions apply to all users and to all content on the platform. The user may not create, publish, share or otherwise interact with content that in any way breaches these Terms and Conditions.

Age

The Services are reserved exclusively for users who have reached 16 years of age. Registration or use of the platform by persons under 16 years of age is not permitted.

The user declares, under their own responsibility, that they have reached 16 years of age at the time of registration. The Controller reserves the right to adopt age-verification measures and to suspend or delete the account should the failure to meet the age requirement emerge.

Safety of minors and prevention of abuse

Selfiestreet adopts strict measures for the protection of minors and to prevent any form of abuse of minors within the platform. Selfiestreet undertakes to comply with all local and international laws and regulations concerning the protection of minors, applying the same rules wherever the app is available. Any sexual content concerning minors is prohibited. The platform uses artificial intelligence and image recognition systems to filter and block inappropriate content, ensuring the safety of users and minors. Users may report suspicious content or conduct through the “Report” button in the app or by sending an e-mail to info@selfiestreet.it. Reports are continuously monitored by the moderation team. For any questions from users or requests from the authorities regarding the safety of minors, a direct channel is available at the address info@selfiestreet.it. All reports and data collected for the purposes of the safety of minors are processed in accordance with articles 6, 9 and 32 GDPR, limiting the retention to only the time strictly necessary for the management of the report and of the security procedures.

Any third-party data and images

The user may not use the identity of other persons or provide inaccurate information and may not create accounts for other persons, except with their express authorisation.

The platform allows the publication of images and videos that may contain the personal data of third parties. In this regard, the user warrants that they are the holder of the rights to the content uploaded and that they have acquired every necessary consent or authorisation pursuant to the legislation in force.

The user may not undertake actions that in any way may infringe the rights of third parties, with particular reference to intellectual property rights. In particular, should the content uploaded depict minors, the user warrants that they have obtained the consent of the person exercising parental responsibility or legal guardianship.

The user acknowledges and accepts that the content uploaded to the platform, where broadcast via billboard or other digital media in places open to the public, may entail a broad and potentially indeterminate dissemination of the image and personal data of the persons represented therein.

To this end, the user warrants that they have acquired, before uploading and broadcasting, an explicit, free, informed and specific consent from all persons who may be present in the content, suitable to also cover the dissemination in public contexts and, where applicable, for promotional or commercial purposes.

Prohibited activities on the platform

The user must not use the platform to carry out actions in breach of the laws in force of a criminal, civil or administrative nature.

The user may not act in an unlawful, deceptive or fraudulent manner or for a purpose that breaches the law. They may not propose the broadcasting of content that refers to conduct or acts dangerous to their own safety and to that of third parties, including through the encouragement of acts of emulation or referable to violent acts or conduct.

They may not upload content of a political, religious or sexually explicit nature or that promotes sexually explicit material; that contains or promotes violence or discrimination based on race, religion, sexual orientation, gender identity, age, state of health or disability, or that is otherwise harmful; that constitutes or encourages practices of bullying, the commission of offences or dangerous activities.

They may not propose the broadcasting of content that infringes the rights of third parties (such as intellectual property, privacy and the personality rights of living or deceased persons).

The user may not adopt conduct aimed at impairing the operation of the services. They may not use or attempt to use the account of another user without their authorisation.

The use of the platform for promotional, advertising or commercial purposes is permitted exclusively in compliance with these Terms and with any guidelines or policies adopted by Selfiestreet. Selfiestreet reserves the right to authorise, restrict or prohibit, at its own discretion, the broadcasting of content for promotional or commercial purposes, as well as to provide for specific economic or contractual conditions for such uses. In any event, the broadcasting of misleading, unauthorised advertising content or content in breach of the applicable regulations remains prohibited.

User content

By creating their own account, the user grants Selfiestreet the authorisations necessary for the provision of the Services.

In particular, the user gives their consent pursuant to art. 4 point 11) of Regulation (EU) 679/2016 (“GDPR”) to the broadcasting of their content in accordance with the modalities provided by Selfiestreet.

The user, by uploading content to the platform and scheduling its broadcasting, grants Selfiestreet a non-exclusive, free-of-charge, transferable and sublicensable licence to use, reproduce, broadcast and communicate it to the public. Such use may take place, by way of example and not limitation:

• through billboards and digital screens installed in places open to the public;
• on digital, promotional and commercial channels connected to the Services;
• within the scope of communication, marketing and promotion initiatives for the platform.

The user acknowledges that the broadcasting of content may take place in public contexts and with broad visibility, also potentially for the benefit of third parties, and declares that they have acquired all the rights, consents and authorisations necessary for such uses.

The user is responsible for the content that they make available on the platform and must hold all the rights necessary to create, publish or share it.

The user undertakes to hold harmless and indemnify Selfiestreet S.r.l., as well as its directors, employees, collaborators and partners, from any damage, liability, cost, charge or claim, including legal expenses, arising from: the breach of these Terms and Conditions; the publication, broadcasting or use of the content uploaded by the user; the infringement of the rights of third parties, including, by way of example, image rights, confidentiality rights, personal data protection rights and intellectual property rights.

The user also undertakes to compensate Selfiestreet for any damage or cost incurred as a consequence of the aforementioned breaches.

The content created, published or shared by the user may be shared across the entire platform. Selfiestreet does not claim ownership of the content published by the user, which remains the exclusive property of the user, who is therefore free to share it with anyone, at any time.

The user may also delete their content individually or collectively, through the deletion of their account.

The user accepts that Selfiestreet may download and install updates to the Services on their device.

External connections to third-party platforms or applications will be governed by the terms and conditions of the platforms or applications themselves. The platform may also contain links to websites, information, materials, products and services of third parties that are not provided by Selfiestreet and in relation to which Selfiestreet assumes no liability.

Prohibited content: reporting and removal

It is possible to report unlawful content or content that breaches these Terms and Conditions through the platform's reporting features or by sending an e-mail to the address info@selfiestreet.it.

Selfiestreet reserves the exclusive and unquestionable right to approve, refuse or remove at any time and without any obligation to state reasons the content proposed by users.

Should Selfiestreet detect a breach by the user of the Terms and Conditions set out above or of the regulations in force, or an infringement of the intellectual property rights of third parties, the user will be notified of the breach and Selfiestreet reserves the right to remove the non-compliant content and/or to suspend or remove their account and/or to refuse or discontinue, in whole or in part, the provision of the Services to the user.

Selfiestreet reserves the aforementioned rights also where reasonably deemed necessary to avoid or mitigate prejudicial consequences to itself or in order to protect the community.

In the event of the exercise of the aforementioned rights, Selfiestreet will inform the user thereof, who will be able to provide the relevant reasons. The user may address the platform operator by sending an e-mail to the address info@selfiestreet.it if they intend to lodge a complaint against the actions taken by Selfiestreet or if they wish to disable or permanently delete their account. When the user requests the deletion of the content or of their account, the deletion process is carried out within 30 days of the request. During the content deletion process, the content is no longer visible to other users, but nonetheless remains subject to these Terms and Conditions.

Termination and management of disputes

The user may discontinue the use of the Services at any time by deleting their account. Selfiestreet reserves the right to modify, suspend or terminate the user's access to the Services for the reasons indicated in these Terms and Conditions.

In the event of disputes relating to the use of the Services, the user may lodge a complaint with the platform operator by sending an e-mail to the address info@selfiestreet.it and following the procedures indicated, or exercise their rights in relation to the personal data protection legislation as provided in the Privacy Notice (Privacy Policy).

Selfiestreet may make changes to the Services and to the Terms and Conditions set out above. In such a case, it will notify the user at least 30 days in advance, so that they can be consulted by users before their entry into force. If the user wishes to continue using the Services, they will be required to comply with the updated Terms and Conditions. If they do not wish to accept any updates, the user may delete their account.
